Sales conditions

1. Identification and contact information

The products for sale on https://www.vistaexpert.it/ (hereinafter referred to as the "Website") are sold and invoiced by MEETING s.r.l. UNIPERSONALE (hereinafter "Meeting"), located at Via Pozzillo Zona Industriale Ponteselice – 81100 Caserta (CE), a company registered with the Chamber of Commerce of Caserta under no. REA 208683 of the Business Register, VAT number 02964400614.

For any information regarding orders, shipments, and, more generally, purchases, you can contact the Vistaexpert customer service through the contact form in the "Contact Us" section of the Website.

 

2. Nature of the service

Meeting provides sunglasses, prescription glasses, and accessories for glasses purchased directly from manufacturers and authorized retailers. Meeting does not sell used, irregular, or lower quality products than the corresponding standards offered on the market.

 

3. Acceptance of the general sales conditions and conclusion of the contract

3.1) The contract concluded between Meeting and the Customer (i.e., the individual, natural person, making the purchase on the Website, not attributable to their commercial, entrepreneurial, or professional activity) shall be deemed concluded upon acceptance of the order by Meeting. In case of non-acceptance of the order, Meeting will promptly notify the Customer.

3.2) By placing an order through the various methods provided, according to the order form on the Website (hereinafter the "Order"), the Customer declares to have read all the information provided during the purchasing process and fully accepts these general sales conditions (hereinafter the "Conditions").

3.3) These Conditions may be printed or saved on durable media, in compliance with the provisions of art. 12 of Legislative Decree no. 70/2003 and art. 51 of Legislative Decree no. 206/2005, as amended by Legislative Decree no. 21/2014.

 

4. Purchasing methods

4.1) The products offered for sale by Meeting are exclusively those available on the Website at the time of placing the Order, as described in the respective information sheets.

4.2) It is understood, in any case, that the images accompanying the product description sheet are for informational purposes only and may not perfectly represent its characteristics but may differ, for example, in color and size (also due to the browser and monitor used to access the Website and view the images).

4.3) To place an Order, the Customer must complete the corresponding form on the Website in its entirety and send it after carefully reviewing the Conditions, as well as the characteristics of the product and/or products they intend to purchase. The Customer must also request from Meeting, if desired, the issuance of a tax invoice relating to the purchase, pursuant to art. 22 of Presidential Decree no. 633/1972.

4.4) The correct receipt of the Order is confirmed by Meeting through an email response sent to the email address provided by the Customer. This confirmation message will briefly summarize the purchase conditions, as required by applicable law, as well as the data entered in the Order, so that the Customer can verify them and promptly communicate any necessary corrections to incorrect data.

4.5) The purchase of contact lenses is only for those who already use contact lenses. By confirming the order, the buyer declares that this is not their first purchase and that they do not have any tolerance problems in using contact lenses.

4.6) The purchase of custom prescription lenses is made through contact with our customer service, to which the prescription and desired frame must be sent. Our team of opticians will send a quote proposal, after acceptance of which the Customer will receive a link to purchase the pair of lenses and frame, selecting the desired payment method.

 

5. Prices and Payment Methods

5.1) The prices indicated on the Website are to be considered inclusive of taxes and VAT. Any shipping costs or payment fees are communicated to the Customer in advance through the Website or these Conditions.

5.2) The following payment methods are available:

- PayPal: The Customer can use the PayPal circuit for payment according to its specific terms.

- Amazon Pay: The Customer can use the Amazon Pay circuit for payment according to its specific terms.

- Credit card: In case of purchase by Credit Card, the transaction may be processed through the secure Shopify Payments server or another secure server chosen by Meeting. Under no circumstances and at no stage of payment will Meeting be able to know the Customer's credit card information, transmitted via secure connection directly to the banking institution's website that manages the transaction. No Meeting computer archive will store this data, and therefore, Meeting cannot be held responsible for any fraudulent and unauthorized use of credit cards by third parties at the time of payment.

- Installment payment with PayPal, Scalapay, and Klarna: These are financing methods that allow the Customer to buy and receive products immediately, paying in 3 or 4 equal installments monthly.

- Bank Transfer: In case of purchase by Bank Transfer, the Customer will view the bank details for payment after placing the order. The shipment of the goods will only take place upon actual receipt of payment (sending the bank statement is not valid), even if the indicated shipping times are 24 hours. After 10 days from the date of order acceptance without Meeting having received the bank transfer credit, Meeting will cancel the order and notify the Customer by email to the email address provided by the Customer.

 

6. Product Availability, Delivery, and Related Expenses

6.1) For each product on the Website, the product availability and estimated shipping date are indicated with the following terminology:

- 24h: the product is available in our central warehouse, and shipping is carried out within 24 hours.

- 10 working days: the product is not available in our central warehouse and is ordered from our suppliers. In most cases, the product will be shipped within this period. However, if the product is not available from the suppliers, we undertake to contact the Customer to inform them of the waiting times and offer the option to wait, cancel the order, or replace the product. In case of no response from the Customer, Meeting will cancel the order and refund the entire order amount within 21 (twenty-one) days from the order date, sending an email to the email address provided by the Customer.

- Out of stock: the product is currently out of production and not available for purchase.

6.2) For all orders received from Friday after 2:00 PM until Sunday, or on bank holidays, processing begins on the next business day. In these cases, shipping times are calculated from the start of order processing.

6.3) For all orders of prescription frames with custom and prescription lenses, the processing of custom lenses in our laboratory takes approximately 4-5 working days.

6.4) The purchased products will be shipped to the address indicated by the Customer in the Order within the times indicated on the product sheet from the acceptance of the Order by Meeting, at the cost specifically indicated on the Website before sending the Order. Meeting reserves the right not to proceed with the shipment of the goods, even after accepting the order, in case of anomalies in the received order or incorrectly calculated amounts. In any case, for deliveries to be made outside Italian borders, shipping costs and delivery times may vary.

6.5) Regarding deliveries requested to countries not belonging to the European Union, any import customs duties will be borne by the recipient. Therefore, the Customer is invited to contact the customs authorities of their country in advance to verify costs and any import limits.

6.6) The delivery times indicated by Meeting are purely indicative as they are subject to factors that do not allow for exact determination. A delay in delivery does not entitle the Customer to refuse delivery or request compensation.

6.7) Shipping times are calculated only after payment of the order and not upon its receipt. In case of payment by bank transfer, shipping will only take place after the actual receipt of payment (sending the bank statement is not valid). We do not guarantee the initially indicated shipping times on the product sheet upon receipt of the bank transfer.

6.7.1) If the package should be returned to the sender due to failed delivery, Meeting will contact the Customer to attempt re-delivery; otherwise, in case of no response from the Customer, Meeting will cancel the order and refund the order amount, minus the shipping costs, within 21 (twenty-one) days from the order date, sending an email to the email address provided by the Customer.

6.7.2) Meeting reserves the right to modify or update the products offered on the Website at any time, without prior notice.

 

7. Responsibility

7.1) All products are carefully checked by Meeting before shipping to ensure their integrity. Upon delivery of the products, the Customer is required to check:

- that the packaging is intact, not damaged, wet, or otherwise altered, including closure materials (e.g., adhesive tape).

- verify that the products are intact and correspond to what was ordered.

Any anomalies and damages to the packaging and/or the product must be immediately reported by placing a specific reservation on the delivery document to be returned to the courier.

7.2) If the products do not correspond to those ordered, the Customer is required to inform Meeting promptly through the contact form in the "Contact Us" section of the Website and has the right to demand execution of the order, upon return of what was received, or, in case of subsequent unavailability of the ordered products, to order different items of the same nature or, alternatively, to be reimbursed for any price difference or to cancel the order.

7.3) Meeting is not responsible for delayed and/or failed delivery of the product for which the courier used is responsible.

 

8. Right of withdrawal and Product Replacement

8.1) Under Article 52 of Legislative Decree no. 206/2005, as amended by Legislative Decree no. 21/2014, the Customer may withdraw from the Conditions and therefore from the purchase contract for any reason, without the need to provide reasons and without any penalty, within 14 (fourteen) days from the date of receipt of the products.

8.2) Only for shipments in Italy, the Customer may alternatively request product replacement within the same timeframe.

8.3) Under Article 55, paragraph 2, letter c), of the Consumer Code, the right of withdrawal (under Legislative Decree no. 206/2005), cancellation, or return does not apply to orders of custom products (custom and prescription lenses).

8.4) To exercise the right of withdrawal under the previous Article 8.1 or to request product replacement, the Customer must send a communication to Meeting indicating the order number, within the specified timeframe, through the contact form in the "Contact Us" section of the Website.

8.5) In case of withdrawal or product replacement, the Customer will receive an email containing the return label and instructions for preparing and returning the package to Meeting within 7 days from the date of creating the shipping label. Meeting reserves the right to refuse returns beyond the aforementioned deadlines and to cancel shipping labels that have exceeded the 7-day limit from the creation date.

8.6) In case of withdrawal, shipping costs are borne by Meeting only for orders shipped to the following countries: Italy, Germany, France, Spain, Austria, the United Kingdom, and the United States.

8.7) In case of replacement, shipping costs are borne by Meeting only for orders shipped to Italy and only for sunglasses or prescription frames.

8.8) The goods must be returned intact, complete with all their parts and in the original packaging, stored and possibly used for the time strictly necessary to establish and verify its nature, characteristics, color, and size, with normal diligence, without signs of wear or dirt, in compliance with the conditions listed below:

- the right of withdrawal or product replacement may apply to the product purchased in its entirety;

- the right of withdrawal or product replacement may only apply to sunglasses and prescription frames available on the Website. Any custom and prescription lenses are excluded.

- for withdrawal or product replacement to be possible, the product must be intact and returned in the original packaging, complete with all its parts (including packaging, case, warranty seal, any informational note, or other documentation and accessory equipment);

- any customs fees (if applicable) for returning the goods will be borne solely by the Customer and will be deducted from the refund amount.

- shipping, until the certificate of receipt at the warehouse indicated by Meeting, is under the complete responsibility of the Customer;

- in case of damage to the goods during transport, Meeting will inform the Customer to promptly report the claim to the chosen courier and obtain the corresponding refund; the product will then be made available to the Customer, simultaneously canceling the withdrawal request;

- Meeting will not be liable in any way for damage, theft, loss occurring during or in any way due to the return shipment.

8.9) In case of product replacement, once the products to be replaced are received, Meeting will send an email with the summary of the replaced products, the indication of delivery times, and any differences in the amount to be paid.

8.10) Meeting will reimburse the Customer the entire amount already paid within 15 (fifteen) working days from receipt of the product, through the procedure of reversing the charged amount, using the same payment method used by the Customer for the initial transaction.

8.11) In any case, the Customer will forfeit the right of withdrawal or the possibility of product replacement in cases where Meeting finds that:

- the returned product and/or its accessories, and/or its packaging are not intact (e.g., damaged, deteriorated, and/or dirty);

- the product is missing its outer packaging and/or original inner packaging (e.g., lacking the warranty seal);

- the product is missing its integral elements and/or accessories (e.g., case, microfiber, etc.)

In the event of forfeiture of the right of withdrawal or the possibility of product replacement, Meeting will return the purchased product to the sender, debiting the price of the product already refunded, if applicable. Shipping costs are borne by the Customer. At the discretion of Meeting, a partial refund may be offered to the Customer.

 

9. Guarantees

9.1) All products sold by Meeting are covered by the manufacturer's legal conformity warranty for a period of 24 (twenty-four) months from the date of delivery of the product for conformity defects, pursuant to Title III of Legislative Decree no. 206/2005. To benefit from warranty assistance, the Customer must keep the invoice, or payment receipt, together with the transport document and file a formal complaint through the contact form in the "Contact Us" section of the Website within a maximum period of 2 (two) months from the date on which the defect was discovered.

9.2) The warranty for conformity defects will apply provided that the product has been used correctly, in accordance with its intended use and as provided in the instructions for use and maintenance accompanying or provided with the product.

9.3) Following the report, in case of non-conformity of the products, the Customer will be entitled to obtain their restoration without charge, through replacement with an identical or equivalent product, or to request a refund.

9.4) In cases where warranty applications involve the return of the product, the same must be returned by the Customer in the original packaging, complete with all its parts (including packaging and any documentation and accessory equipment).

11. Privacy

11.1) The personal data collected when placing the Order will be processed by Meeting solely for the purpose of satisfying the Customer's explicit requests, in compliance with EU Regulation 2016/679 and the privacy policy on the Website. Any further processing will be carried out only with the express consent of the Customer.

 

12. Applicable Law

12.1) The sales contract governed by these Conditions and its execution are governed by Italian law, with the disapplication of conflict rules and the United Nations Convention on Contracts for the International Sale of Goods. For the resolution of any related disputes, the Court of the Customer's place of residence will have jurisdiction.

12.2) We wish to inform you that the European Commission provides a platform for online dispute resolution, including cross-border disputes, accessible on the website http://ec.europa.eu/odr.
